The following Contract Terms and Conditions are applied to each agreement between the Customer (“Contracting party”) and soloTravelling, whose registered office is in Palermo, Viale Regione Siciliana 3350, VAT 05581300828. SoloTravelling invites Customers to read them carefully – point by point - to be informed of the rights and obligations issuing from every agreement regarding all services offered by soloTravelling.
Please note that, with reference to “soloPayinloco properties”, soloTravelling acts simply as agent, therefore Customers will deal directly with “soloPayinLoco property” supplier. For all other bookings, customers will sign a contract directly with soloTravelling.
1. CONTRACT DRAWING UP
To initiate a booking, Customers may either phone us, or send us an e-mail, or an on-line enquiry on our website. The agreement with soloTravelling becomes effective as soon as soloTravelling receives a deposit of 30% of the total amount agreed with the Customer. The Contracting party takes on the obligation of filling soloTravelling booking form only with true and complete personal data. The Contracting party must be at least 18 years old, and authorised to go ahead with the booking on the basis of the following Contract Terms and Conditions by all members of his/her group. The Contracting party undertakes the obligation to take care of all payments due to soloTravelling.
2. PAYMENTS
The payment of due amounts follows different rules according to the properties you select:
- Staying in “soloPrivate” properties - Bookings made earlier than 60 days before departure date
When confirming the booking, the Contracting Party will have to pay soloTravelling 30% of the total amount agreed, to secure availability of the selected property; full balance payment is to be effected within 60 days from the beginning of the stay.
- Staying in “soloPrivate” properties - Bookings of more than 60 days before departure date
When confirming the booking, the Contracting Party will have to pay soloTravelling the total amount agreed to secure availability of the selected property.
- Staying in “soloPayinLoco” properties
The Customer's booking will be secured by paying an agreed deposit to soloTravelling. Full balance payment will be effected directly at the property when checking out.
We accept payment exclusively by bank transfers or cheques made out to “soloTravelling”.
2.1 SECURITY DEPOSIT
When choosing a “soloPrivate” property, the Customer will pay the Security Deposit specified in the booking form to the property owner or to a soloTravelling local manager soon after arrival, on pain of being denied access by the owner. Security Deposit will be paid in cash in Euros, or by cheque made out to a EU bank in UK Sterling or Euros, or by traveller's cheques in US$, UK £ or €. If Security Deposit is paid in UK Sterling or US$, its amount will be calculated in Euros adopting the actual conversion rate published on whatever newspaper soloTravelling will select on payment date. This amount serves as money security to grant the property owner quick compensation either for bills left unpaid, or damages caused by the Customer or members of his group on checking out the selected property. With reference to possible damages or bills whose quantification exceeds the pre-arranged security deposit amount, compensation will have to be arranged directly with the property owner; soloTravelling declines all responsibility in this case.
When choosing to stay in a “soloPayinloco” property, the Customer will be requested to furnish his credit card details in the booking form at the time of booking. The soloPayinLoco property supplier will likewise request the Customer authorization to charge his credit card with a security deposit, either in case of damages caused to the property by the Customer or members of his group, or for compensation of unpaid bills, or cancellations exceeding the time limit specified in the “contractual terms and cancellation policy” of the “soloPayinLoco ” property selected.
3. CHANGING THE RESERVATION AND CANCELLATION
The Customer is allowed to change his reservation any time within 60 days from the announced arrival date. SoloTravelling engages to check availability and make whatever change is requested by the Customer on his staying plan. The Customer is likewise allowed to cancel his reservation within 60 days before announced arrival date, but for cancellations no refund is provided for the Customer towards the deposit already paid.
The Customer is granted a refund for whatever deposit already paid if soloTravelling receives written communication of booking cancellation within 10 days from the date of completion of bank transaction payment, and if the aforementioned 10 days precede the 60 days time limit prior to arrival. For all booking cancellations communicated to soloTravelling later than 60 days prior to arrival date, the Customer will get no refund for whatever amount already paid as deposit, which will therefore considered as a penalty.
4. CHANGES AND CANCELLATIONS MADE BY THE SOLOTRAVELLING
SoloTravelling is allowed to change data and conditions of use of managed properties at any time. If changes affect a reservation already made by the Customer, soloTravelling will inform the Customer as soon as possible.
If changes should cause unavailability of the structure already booked by the Customer, soloTravelling will grant the Customer the opportunity either:
a) to accept the occurred changes or modify his/her reservation in favour of other available structures without any penalty;
b) to cancel the reservation granting full refund.
Only if cancellation of an existent reservation is made by soloTravelling earlier than the aforementioned 60 days before arrival date, and only if the aforementioned cancellation is due to sudden unavailability of the property selected and all alternative solutions offered to the Customer will not be accepted, the Customer will be refunded in full. In compensation of the disservice, soloTravelling will furthermore refund the Customer with the below listed amounts:

5. ARRIVAL AND DEPARTURE TIMES
Arrival to selected property is between 4pm and 7pm and has to be agreed with soloTravelling. Booked property has to be vacated within 10am of departure day. Whatever change of day or time of arrival has to be communicated in writing and be approved by soloTravelling at least 10 days prior to announced arrival date. In case of unexpected delay, the Customer is kindly requested to advise soloTravelling as soon as possible.
In case of:
intentionally omitted delay;
-
unexpected delay causing soloTravelling agents’ inability to be on the spot on time;
-
impossibility by owner or his agent to accept new time of arrival, even if timely communicated ;
soloTravelling claims the right to arrange unilaterally a new time of arrival, as far as delivery of property keys is concerned. If delivery is not possible on new arrival time, solo Travelling may decide to deliver property keys on the next available day, and may ask the Customer compensation of whatever charges may have been caused by unplanned displacement. The Customer will not be refunded for an overnight stay under no circumstances. SoloTravelling declines all responsibility regarding this matter.
In case of inability to occupy the structure on the arranged date because of unexpected occurrences during travel such as strikes, delays or personal reasons, the Customer will not be refunded under no circumstances.
For departures unilaterally anticipated by the Customer, soloTravelling declines all responsibility and will not concede any refund.
6. CHANGES CONCERNING INCIDENTAL ELEMENTS
For all changes made by soloTravelling in case of unforeseen occurrences - such as impossibility for the Customer to make use of arranged services, i.e. sports structures - or due to circumstances beyond soloTravelling control, soloTravelling declines all responsibility, but will grant the Customer the opportunity to change the selected property, if possible.
7. RESPONSIBILITY CONCERNING INCIDENTAL ELEMENTS
SoloTravelling declines all responsibility in case of accidents occurred during the Customer’s staying. For whatever accident causing damages to the host’s property, the owner will be granted compensation according to the conditions listed on paragraph 2.1
8. USE OF SPORT STRUCTURE
When using whatever sports or recreational structures the selected property may offer, Customers are kindly requested utmost care and attention. SoloTravelling declines all responsibility for any damages or accidents caused by wrong use of sports or recreational structures during stay.
9. TRAVEL INSURANCE
SoloTravelling requests the Customer to take out a travel insurance policy as a pre-requisite for any agreement. Therefore it is necessary for the Customer to contact an insurance company before departure, to protect him/herself and members of his/her group against damages of any kind, luggage loss, third-party liability, illness or death. SoloTravelling is actually unable to provide this kind of insurance cover. The Customer is, therefore, required to be personally responsible for it, on pain of being denied access to soloTravelling selected structures. Please note that soloTravelling will not check whether the Customer and his/her group have signed an insurance policy or not, but will reserve the right to unilaterally approve or refuse any agreement.
10. CONTRACT TERMS
The contract designed by soloTravelling observes Italian legislation on the matter, and for any possible dispute, even of interpretative nature, soloTravelling will refer to rules and terms applied on Italian territory. In case of dispute concerning interpretation of the contract text, soloTravelling will refer to the Italian version of the agreement text. Whatever dispute may arise from different interpretations, validity, performances or termination of this contract, the only place of jurisdiction acknowledged by soloTravelling will be the court of Palermo.
